Tree Preservation Orders (TPOs) Conservation Areas
From initial advice to permission granted, we’re here to help.
Where trees are protected by a Tree Preservation Order or Conservation Area controls, certain rules apply.
The questions below explain what this means in practice and how we can support you.
If your tree is protected by a Tree Preservation Order (TPO), permission is usually required before carrying out pruning, reduction, or removal works. The first step is to establish whether the tree is protected and to understand what works may be appropriate.
Yes. Following a site visit, we can confirm whether your tree is subject to a Tree Preservation Order or located within a Conservation Area and explain what this means for you.
No. If consent is required, we can prepare and submit the TPO application on your behalf, including the necessary arboricultural justification. This removes the need for you to deal directly with the Local Planning Authority.
A professional application fee of £30.00 + VAT per application applies.
In most cases, you cannot prune a protected tree without permission, unless the works are exempt. Exemptions may include the removal of deadwood or works required to address an immediate safety risk. We will advise whether exemptions apply and ensure the correct process is followed.
If a protected tree has been damaged, is storm-affected, or presents an immediate risk, emergency works may be permitted. In these situations, works can often be carried out under a Section 14 – 5 Day Notice, which notifies the Local Planning Authority of the proposed works before they take place.
We can advise whether this applies, prepare the required notification, and ensure that any emergency works are appropriate, proportionate, and properly documented.
Once a TPO application has been submitted, the Local Planning Authority will usually issue a decision within up to eight weeks.
For trees located within a Conservation Area, a six-week written notice is normally required before works can proceed.
If an application is refused, the decision notice will explain the reasons why. This does not always mean that no work can take place, but that the Local Planning Authority has not agreed with the proposed works as submitted.
We can review the decision with you and advise on the most appropriate next step. This may include amending and resubmitting the application or, where appropriate, appealing the decision within the required timeframe. We will always discuss the options clearly and help you choose the most practical and proportionate route forward.
Once consent has been approved, we will arrange the works and carry them out strictly in accordance with the approved specification.
No. We will not carry out any works to protected trees until the correct permissions or notice periods have been confirmed, unless emergency works are permitted under the appropriate exemption or notice process.
We’re happy to talk through your situation and explain the next steps clearly and simply.
